Terms of Service

1 — Purpose

These Terms of Service (“ToS”) govern access to and use of the Incipite service, accessible at incipite.com, operated by DE.H.VS, a sole trader registered in France and represented by Hadrien Hubert (“the Publisher”).

By using the service you agree to be bound by these ToS in full.

2 — Description of the service

Incipite is a prior art proof service that allows any creator to compute the cryptographic fingerprint (SHA-256) of a file directly in their browser, then anchor this fingerprint on the Bitcoin blockchain via the OpenTimestamps protocol.

Your file never leaves your device. Only the 64-character fingerprint is transmitted to Incipite servers and to OpenTimestamps.

Incipite provides strong prior art proof. It does not constitute a copyright registration and creates no intellectual property title under any applicable law.

3 — Account registration

Access to the certification service requires an account. Registration is open to any adult individual or legal entity with a valid email address.

You agree to provide accurate information, including your full name, as this information appears on the generated certificate and constitutes part of its probative value.

You are responsible for maintaining the confidentiality of your login credentials.

4 — Plans and pricing

The service is available under the following tiers:

  • ·Free: 1 lifetime certification included, no payment required.
  • ·Per deposit: €2 per additional certification, no subscription.
  • ·Pro: €9/month, unlimited certifications, cancel anytime.

Payments are processed by Stripe, Inc. The Publisher retains no payment card data. The Publisher is VAT-exempt under French CGI Art. 293B — displayed prices are net of tax. Subscriptions renew automatically until cancelled from the user dashboard.

5 — User obligations

You agree to:

  • ·not use the service for fraudulent or unlawful purposes;
  • ·not attempt to circumvent quota or payment mechanisms;
  • ·not certify content for which you are not the author or authorised rights holder;
  • ·not present a certificate in a misleading way, in particular by suggesting it constitutes an official copyright registration.

6 — Limitation of liability

The Publisher cannot be held liable for how courts assess the probative value of an Incipite certificate in any particular dispute. The cryptographic robustness of the Bitcoin anchor is well-documented and strong; its legal recognition depends on each jurisdiction.

The Publisher endeavours to maintain the service with due care but does not guarantee uninterrupted availability, in particular in the event of maintenance of the OpenTimestamps protocol or the Bitcoin blockchain.

The Publisher's liability shall in no event exceed the amounts paid by the user in the 12 months preceding the claim.

7 — Data retention

Certified fingerprints and associated metadata (depositor name, date, blockchain status) are retained indefinitely to allow public verification at /verify/[hash].

Deleting your account does not delete fingerprints anchored on the Bitcoin blockchain — it is immutable by design. However, associated personal information may be anonymised on request, in accordance with our Privacy Policy.

8 — Intellectual property

You retain full ownership of all works certified through Incipite. Incipite claims no rights over files (which are never transmitted to us) or over cryptographic fingerprints.

The service interface, source code and design are the exclusive property of the Publisher and may not be reproduced without authorisation.

9 — Changes to these ToS

The Publisher reserves the right to amend these ToS at any time. Users will be notified by email of any material changes. Continued use of the service after notification constitutes acceptance of the updated terms.

10 — Cancellation and refunds

You may cancel your subscription at any time from your account dashboard. Cancellation takes effect at the end of the current billing period; no partial refunds are issued for the remaining period unless required by applicable law.

Right of withdrawal — express waiver for immediately performed digital service (Consumer Contracts Regulations 2013, reg. 36; EU Consumer Rights Directive 2011/83/EU, art. 16(m)) — The certification service is fully performed immediately after payment: your file's SHA-256 fingerprint is computed, submitted to the OpenTimestamps protocol and the resulting certificate is generated, all before the 14-day statutory withdrawal period expires.

By completing payment you expressly confirm that:

  • ·you request that the service begins immediately, before the end of the 14-day withdrawal period;
  • ·you acknowledge that, once the certification is delivered, your right to cancel and obtain a refund for that specific certification is lost;
  • ·this waiver applies only to the individual certification delivered — it does not affect your right to cancel a Pro subscription for future billing periods.

For refund requests on Pro subscriptions (unused billing periods), please contact legal@incipite.com within 14 days of purchase. Nothing in these ToS affects your statutory rights under the Consumer Rights Act 2015 or any other applicable mandatory consumer protection legislation.

11 — Governing law and disputes

These ToS are governed by French law. In the event of a dispute, you are invited to contact the Publisher at legal@incipite.com to seek an amicable resolution before commencing any proceedings.

Nothing in these ToS affects your statutory rights as a consumer under the law of your country of residence, including (where applicable) rights under the UK Consumer Rights Act 2015 or the EU Consumer Rights Directive 2011/83/EU.

For alternative dispute resolution, UK consumers may contact the relevant ADR scheme for their sector or contact the Publisher directly at legal@incipite.com before commencing formal proceedings.
